When the lack of conformity manifests itself after 6 months and in doubtful cases, the manufacturer could demand an independent expert report to process the guarantee. In obvious cases of malfunction or irregular operation in warranty period there is no problem whatsoever.
In any case, during the time that the consumer is deprived of the product, the calculation of the term of the guarantee is suspended; For example, if the repair of an object lasts 15 days, the guarantee period will end 15 days later than originally planned.
Any manufacturer that has a warranty greater than 2 years that marks the current Law, should be processed directly with the manufacturer is not responsible for such cases DOMOTICALIA.
The shipping costs generated by the processing of the product warranty will be borne by DOMOTICALIA in those cases where it is assumed that the lack of conformity exists in the acquired good. It should always be done following the instructions indicated by DOMOTICALIA, upon request and acceptance.
Conditions for companies and distributors: When the customer is a distributor, or invoices as a company (non-physical person), the shipping costs to our facilities will always be borne by the customer, since the law on consumer goods does not regulate the sale between companies . In addition, the warranty in these cases will be as stipulated by the manufacturer of the product.
The consumer may complain to the seller when the product is not in accordance with the contract:
The acquired good does not fit the description made by the seller.
The acquired good does not serve for the uses to which consumer goods of the same type are ordinarily destined.
It is not suitable for the special use that would have been required by the consumer and that the seller has accepted.
It does not present the expected quality and behavior, especially taking into account public statements (advertising, brochures, labeling ...) about its specific characteristics made by the seller or the manufacturer.
The consumer and user has the right to:
Repair or replace. The consumer and user may opt for the repair or replacement before the seller, unless one of the two options is impossible or disproportionate. The one that has a higher cost. No non-expendable goods (when they are specific in nature) or second-hand goods can be substituted. Both the repair and the replacement must be done within a reasonable period of time and completely free of charge for the consumer.
NOTE: The guarantee can be managed directly with DOMOTICALIA, although some manufacturers offer direct management of faults / defects / incidents produced in their products to provide a quality after-sales service and reduce times. In these cases DOMOTICALIA will inform you so that you can decide whether to process it with us or with them.
Price reduction or termination of the contract. Proceed when the consumer and user can not demand repair or replacement and in cases where it would not have been carried out within a reasonable time or without major inconveniences for the consumer and user. The resolution will not proceed when the lack of conformity is of minor importance.
Processing of guarantee of promotional products, packs or gifts. If it is a gift, it will be replaced by another one equal or, in the case that it is not possible, of a similar value, never for money. If it is a product in promotion or pack, if repair or replacement is not possible, the equivalent amount will be reimbursed, calculated taking into account the real price of the product and the discount obtained by the customer when buying it in promotion.
Cancellation of guarantees
The guarantee may be canceled for the following reasons:
Incorrect use, manipulation or maintenance by the Client of a computer, multimedia kit, component or peripheral.
Software and / or virus problems.
Components burned by surges or electrical current surges.
Broken or damaged components subjected to impact.
Incorrect repair, modification or expansion by the customer of a device or kit.
Deterioration, elimination or concealment by the customer of the DOMOTICALIA guarantee label or of the manufacturer of all products (including those that are part of a team, multimedia kit or semi-equipment) manufactured or distributed by DOMOTICALIA.
In short, no damaged material or obvious signs of incorrect handling will be accepted.
The guarantee does not cover:
The warranty does not cover those defects caused by incorrect use of the product and / or manipulation of the product other than that necessary to establish its nature, characteristics or operation. In these cases, the consumer must take charge of its repair. The following are therefore excluded from the guarantee:
Defects and deterioration caused by external events, accidents, mainly electrical accidents, wear and tear and use not in accordance with the instructions of DOMOTICALIA.
Products modified or repaired by the customer or any other person not authorized by DOMOTICALIA, as well as the products that are the subject of a specific support contract.
Incorrect software / hardware configuration, by the client, of a computer, component or peripheral. Incorrect software / hardware configuration or equipment failure caused by a component not supplied by DOMOTICALIA and incorporated by the customer.
Infection of computer viruses, by the client, in equipment, storage systems or additional software.
For these purposes, DOMOTICALIA informs that the Consolidated Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options to exercise the right of withdrawal. Among them, it is possible to do so by filling out a form electronically. In order to shorten the times and that you can make the return of a comfortable and without delay, from DOMOTICALIA we advise you to use that option and fill in the withdrawal form.
The repair of the previous cases will be billed. Repair fee: 40 Euros per hour (VAT not included).
These guarantee conditions do not affect the statutory rights of the consumer covered by the applicable legislation.
The optical media (CD-R, CD-RW, DVD-R, DVD + R, DVD-RW, DVD + RW) does not have the right of withdrawal once the packaging or box is opened or unsealed. Only optical media whose packaging or packaging has not been opened can be returned, paying the cost to the customer.
DOMOTICALIA is not responsible for the personal information contained in the device or storage unit. The client is responsible for the data or information in the material to be repaired and for making the pertinent backup copies. Likewise, the guarantee will act with respect to hidden defects and manufacturing defects of the product in accordance with Article 1490 of the CC.
Processing of the guarantee
The consumer and user can process the guarantee by contacting DOMOTICALIA. However, there are certain manufacturers that directly manage faults / defects / incidents produced in their products to provide a quality after-sales service and reduce times. In this case the customer may choose to take or send the damaged product directly to the manufacturer's SAT, generally without any cost to the customer.
In case that the product sent is in perfect condition and the problem is of configuration, it will be returned to the customer at postage due, being able to invoice the labor used in the verification or test of the article supposedly damaged.
